01. Acceptance of terms

These Terms of Service (hereinafter «the Terms» or «this Agreement») govern your access to and use of the Soniqx mobile application (hereinafter «the App»), developed and operated by Evgenii Kondakov trading as ThaiTopApp888 (hereinafter «we», «us» or «the developer»).

By downloading, installing or using the App in any way, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not install or use the App.

These Terms apply alongside our Privacy Policy, which is incorporated herein by reference. Section 3 contains safety information that you should read before using the boost function.

02. Description of the App

2.1 Soniqx is an audio utility for Android. Its purpose is to increase the loudness of audio played on your device — music, video, games, calls, alarms and notifications — whether played through the built-in speaker, wired headphones or a Bluetooth output device. It does not require root access.

These Terms cover every version of the App. They describe the full range of functions the App may offer. Not every function is present or enabled in every version or region, and nothing here is a promise that any particular function will be released or kept. Where a function is not present in your version, the clauses relating to it do not apply to you.

2.2 Depending on the version, the App may provide: a loudness boost, implemented as a software audio effect supplied by the operating system and applied to the device's general audio output stream; a multi-band equalizer and a bass boost control; and direct control of the system volume level. All of these operate through audio interfaces the operating system provides. The App does not listen to, record or analyse the audio playing on your device and does not use the microphone.

2.3 So that your settings continue to apply when the App is minimised or closed, the App runs as a background (foreground) service and shows a persistent notification with controls. Android requires this notification for any such service; it cannot be hidden while the service is running, and stopping the service removes it. The App remembers the settings you last chose and restores them on the next launch.

2.4 Results depend on your hardware. The additional loudness achievable, and the quality of the result, are determined by your device's speaker, amplifier, output device and the limits imposed by its manufacturer and operating system version. On some devices the manufacturer restricts output levels for safety or regulatory reasons, and the effect of the App will be correspondingly smaller or absent. We make no representation that any particular device will reach any particular volume, and this variation is not a defect in the App.

2.5 The core functionality of the App is available free of charge and supported by advertising. Additional features may be unlocked through an optional paid subscription, as described in section 7.

2.6 We reserve the right to add, modify, suspend or discontinue any feature of the App at any time. Where a change removes a feature that formed part of an active paid subscription, section 16 applies.

03. Hearing and equipment safety

Please read this section before raising the volume

The App is designed to produce sound levels above the maximum your device would normally allow. Those default limits exist partly to protect your hearing. Listening at high volume, especially through headphones and especially for extended periods, can cause permanent hearing loss and tinnitus. Hearing damage accumulates gradually and is usually irreversible by the time it becomes noticeable.

3.1 You use the boost and bass boost functions entirely at your own risk and on your own judgement. You are solely responsible for choosing the volume at which you listen.

3.2 We recommend that you: start at a low level and raise it gradually; use the lowest volume at which you can hear comfortably; take regular breaks during extended listening; reduce the level immediately if you experience ringing, muffled hearing, discomfort or pain; and never use the boost function to a level at which you cannot hear what is happening around you, in particular while driving, cycling, walking near traffic or operating machinery.

3.3 Do not use the App to boost audio in situations where impaired hearing or awareness could endanger you or others. This includes any use in road traffic, on a bicycle, at work with machinery, or in any environment where you need to hear warnings, alarms or approaching vehicles.

3.4 Boosted audio can also damage equipment. Driving a speaker, headphone or amplifier beyond its designed operating range may cause distortion, overheating, reduced service life or permanent failure of the transducer. Any such damage is your responsibility. To the fullest extent permitted by applicable law, we accept no liability for damage to your device, headphones, speakers, hearing aids or any other audio equipment resulting from use of the App.

3.5 Boosting alarms, ringtones and notifications may produce a sudden loud sound at an unexpected moment. Take this into account when configuring the App, particularly if you use it with headphones or in a shared environment.

3.6 If you wear a hearing aid or cochlear implant, or have a diagnosed hearing condition, consult a qualified audiologist before using the App. Nothing in the App constitutes medical advice, and the App is not a medical device and is not intended to diagnose, treat or compensate for any hearing impairment.

3.7 Where a version of the App raises loudness only through a software audio effect, it does not alter the safe-listening limiter built into your device by its manufacturer, and that limiter continues to apply.

3.8 Direct system volume control and safe listening limits. Where a version of the App offers direct control of the system volume level, that function may allow output above the level at which your device would normally display a safe-volume warning. Many devices implement that warning in order to comply with safety standards for portable audio equipment, and it exists to protect your hearing. Where the function is offered: it is switched off by default; it requires a separate, explicit confirmation from you before it can be used for the first time; that confirmation screen repeats the warning set out in this section; and it depends on a system permission you must grant yourself in the Android settings and may revoke there at any time. By enabling the function you accept full responsibility for the resulting sound levels and for any consequence to your hearing or to your equipment. If you are in any doubt, leave it switched off. Nothing in this clause is medical advice, and clause 3.9 continues to apply.

3.9 Nothing in this section excludes or limits any liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence.

04. Eligibility and age

4.1 The App is intended for users aged 16 years or older. By installing or using the App you confirm that you meet this requirement and that you have the legal capacity to enter into this Agreement.

4.2 This age limit reflects both the advertising model described in section 6 and the safety considerations in section 3, since the risk of noise-induced hearing damage is greater for children and young people.

4.3 The App is not directed to children, is not marketed to children and is not distributed in any children's or family category. We do not knowingly collect personal data from children. If you are a parent or guardian and believe your child has used the App, contact us at thaitopapp888@gmail.com and we will take reasonable steps to have any associated data deleted.

4.4 If you are under 18 but at least 16, you may use the App only with the consent of a parent or guardian, and any purchase must be authorised by them.

05. Licence granted to you

5.1 We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on devices you own or control, for your own private, non-commercial purposes, in accordance with these Terms.

5.2 All copyright, trademark rights, patent rights, trade secrets and other intellectual property rights in the App — including its source code, icons, graphics, equalizer presets, interface design, layout and documentation — remain with the developer or its licensors. Nothing in these Terms transfers any of those rights to you.

5.3 You should obtain the App only from Google Play or from another channel we have expressly authorised. We cannot guarantee the integrity or proper functioning of copies obtained from unauthorised sources, and we accept no liability for any loss caused by such installations.

5.4 We claim no rights over the audio you listen to while using the App, and the App does not require you to submit any content to us.

06. Advertising

6.1 The free version of the App is supported by advertising delivered through Google AdMob. By using the free version, you accept that advertising will be displayed within the App.

6.2 We do not control the content of individual advertisements and do not endorse the products or services advertised. Any dealings you have with an advertiser are solely between you and that advertiser.

6.3 Details of the data used to deliver advertising, and the controls available to you, are set out in our Privacy Policy. If you are in the EEA, the UK or Switzerland, the App asks for your consent before showing personalised advertising; refusing consent does not prevent you from using the App.

6.4 An active subscription removes advertising from the App.

07. Subscription and payments

7.1 The App offers an optional subscription that removes advertising and unlocks premium features. The plans available, their prices and their billing periods are displayed on the subscription screen inside the App before you confirm any purchase. The terms shown on that screen at the moment of purchase govern the transaction.

7.2 Subscriptions are sold and processed by Google Play. All payments are handled by Google and are subject to the Google Play Terms of Service. We do not receive or store your payment card details.

7.3 Auto-renewal. Subscriptions renew automatically. Unless you cancel at least 24 hours before the end of the current billing period, the subscription renews for a further period of the same length at the then-current price, and the charge is taken from your Google Play account within the 24 hours before the period ends.

7.4 Prices vary by region and are shown in the currency of your Google Play account. We are not responsible for currency conversion charges or fees applied by your bank or payment provider.

7.5 A subscription is linked to the Google account used to make the purchase, not to a device. You may use it on any device signed in to that account, subject to Google Play's family sharing and account rules.

7.6 If a payment fails or a charge is reversed, we or Google may suspend access to premium features until the matter is resolved.

08. Free trial

8.1 Where a free trial is offered, you receive access to premium features at no charge for the trial period stated on the subscription screen.

8.2 Unless you cancel at least 24 hours before the trial ends, the trial converts automatically into a paid subscription and you will be charged the price shown at sign-up. The duration and price are displayed before you start the trial.

8.3 Cancellation during a trial is done through your Google Play account settings, not by deleting the App. See section 10.

8.4 A free trial is limited to one per Google account. Any unused portion of a trial is forfeited if you purchase a subscription before the trial period ends.

09. Restoring a subscription

If you have subscribed but premium features are not available, try the following:

  1. Confirm that you are signed in to Google Play with the same account used for the original purchase.
  2. Open Settings → Subscription inside the App and tap Restore purchases.
  3. Check that your device has a working internet connection, then close and reopen the App.
  4. If the problem persists, uninstall the App, sign back in to your Google account, reinstall Soniqx from Google Play, and repeat the restore step.

If none of this resolves the issue, contact us at thaitopapp888@gmail.com with your Google Play order number and we will help.

10. Cancellation and refunds

10.1 You may cancel at any time through Google Play → Menu → Payments and subscriptions → Subscriptions. Cancellation takes effect at the end of the current billing period, and you keep access to premium features until that date.

Deleting the App does not cancel your subscription. You must cancel it separately through your Google Play account settings, or billing will continue.

10.2 We do not process refunds directly. Refund requests must be submitted to Google in accordance with the Google Play refund policy. We have no control over Google's refund decisions, though we will assist with information where we can.

10.3 Consumers in the European Union and the United Kingdom. You have a statutory right to withdraw from a distance contract for digital content within 14 days. Because the subscription gives immediate access to digital content, that right is lost once performance has begun with your express consent and your acknowledgement that you thereby lose the right of withdrawal — which you give when you confirm the purchase. This does not affect your other statutory rights, including remedies where the service is not as described or not of satisfactory quality.

10.4 Nothing in this section limits mandatory consumer rights available to you under the law of your country of residence.

11. Prohibited use

When using the App, you agree not to:

  1. use the App in any way that endangers you or others, including the situations described in section 3.3;
  2. use the App to cause a nuisance, harassment or distress to other people, including deliberately producing excessive noise in shared or public spaces or in breach of local noise regulations;
  3. reverse-engineer, decompile, disassemble or attempt to derive the source code of the App, except to the extent such restriction is prohibited by applicable law;
  4. modify, adapt, translate or create derivative works of the App, or remove or obscure any proprietary notice;
  5. copy, redistribute, sell, rent, sub-license or otherwise make the App available to third parties;
  6. circumvent, disable or interfere with the advertising, subscription verification or other security features of the App, or obtain premium features without paying for them;
  7. use the App for any unlawful purpose or in breach of any applicable local, national or international law;
  8. attempt to gain unauthorised access to any system, network or data connected with the App;
  9. use automated tools to scrape, crawl or extract data from the App, or to generate artificial advertising impressions or clicks.

We reserve the right to terminate access to the App and to premium features for any user found to be in breach of these restrictions.

12. Third-party services

12.1 The App relies on services operated by third parties, including Google Play services, Firebase and Google AdMob, and on the audio subsystem of your device's operating system. Their availability and behaviour are outside our control.

12.2 An operating system update, a manufacturer change to audio handling, or a change in a third-party service may reduce or remove some functionality of the App. We will make reasonable efforts to restore it, but we cannot guarantee that we will be able to do so.

12.3 Your use of those third-party services is subject to their own terms and privacy policies.

13. Disclaimer of warranties

13.1 The App is provided «as is» and «as available». To the fullest extent permitted by applicable law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.

13.2 We do not warrant that the App will be uninterrupted, error-free, compatible with every device, or free from harmful components, nor that it will achieve any specific increase in volume or audio quality on your hardware.

13.3 In jurisdictions where consumer protection legislation does not permit the full exclusion of implied warranties, those warranties are limited to the minimum extent allowed by law, and your statutory rights are unaffected.

14. Limitation of liability

14.1 To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, punitive or consequential damages arising from your use of or inability to use the App, including loss of data, loss of profit or business interruption.

14.2 Subject to clause 14.4, our total aggregate liability arising out of or in connection with the App shall not exceed the greater of the amount you paid us for the App in the twelve months preceding the event giving rise to the claim, or EUR 50.

14.3 Liability relating to hearing and to audio equipment is addressed in section 3 and is subject to the same limits.

14.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

15. Termination

15.1 You may terminate this Agreement at any time by uninstalling the App. If you hold a subscription, remember to cancel it separately as described in section 10.

15.2 We may suspend or terminate your licence with immediate effect if you materially breach these Terms, in particular section 11. Where the breach is capable of remedy and the circumstances allow, we will give you notice and an opportunity to remedy it first.

15.3 On termination, the licence in section 5 ends and you must stop using the App. Sections 5.2, 13, 14, 17 and 18 survive termination.

15.4 If we terminate your licence other than for breach while you hold a paid subscription, you may seek a pro-rata refund of the unused portion through Google Play, and we will support that request.

16. Changes to the terms

16.1 We may update these Terms at any time. The revised version will be published at this address with an updated effective date, and, where appropriate, announced through an in-app notice.

16.2 For non-material changes, continued use of the App after publication constitutes acceptance of the revised Terms.

16.3 For material changes affecting paid subscription conditions — price, included features, billing cycle or cancellation rules — we will notify active subscribers at least 30 days in advance through an in-app notice or by email. If you do not accept the revised Terms, cancel your subscription before the change takes effect so that you are not charged under the new conditions.

17. Governing law and disputes

17.1 These Terms are governed by the law of the developer's country of permanent residence, without regard to its conflict-of-law provisions.

17.2 Notwithstanding clause 17.1, consumers resident in the European Union or the United Kingdom retain the benefit of the mandatory consumer protection provisions of their country of residence and the right to bring proceedings there.

17.3 In the event of a dispute, the parties shall first attempt to resolve it through good-faith written negotiation within 30 days of written notice. If no resolution is reached, the matter may be submitted to the competent courts of the developer's country of residence, subject to clause 17.2.

17.4 If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision shall be replaced by a valid one achieving the closest permissible effect.

17.5 These Terms, together with the Privacy Policy and the purchase terms displayed in the App, constitute the entire agreement between you and us regarding the App.
